Tekagogo, LLC., its representatives, affiliates, officers and directors (collectively, “Tekagogo,” “Company,” “us,” or “we”) respect your privacy. At Tekagogo, we believe privacy is a matter of trust and strive to manage your personal information fairly and respectfully.

  1. Scope

This Privacy Statement applies to all of our mobile applications, websites, features, or other services (collectively, the “Application”). This Privacy Statement applies to “you” acting as an individual or on behalf of your company as either:

  • A “Tek”: a skilled independent technician
  • A “User”: anyone who uses a Tek’s services

YOUR USE OF THE APPLICATION INDICATES THAT YOU HAVE READ, ACCEPTED AN UNCONDITIONALLY AGREED TO OUR PRIVACY PRACTICES, AS OUTLINED IN THIS PRIVACY STATEMENT, OUR [TERMS AND CONDITIONS]—WHICH ARE INCORPORATED HEREIN BY REFERENCE—AND ANY OTHER APPLICABLE TERMS.

  1. Information We Collect

Tekagogo is a lead generation service provider that utilizes mobile applications and related services to enable Users to identify their specific needs for equipment, logistics and/or software repair or installation services (“Leads”). Teks then follow those Leads to offer Users solutions. To provide this Application, we need to collect, process, and, sometimes, disclose information about you. We limit the amount of personal information collected to that required to support our specific purpose in requesting it.

(a) Personal Information

We may collect your Personal Information, such as a first and last name, phone number, email address, physical address, resume, work history, location information, or other individually identifiable information. As listed below and described in more detail in this section, we get your Personal Information from various sources, including:

  • When you register to use or use the Application;
  • When you leave feedback, such as ratings or compliments;
  • When you call, email, or communicate with us through social media;
  • When you recommend someone for a referral program;
  • When you request services or someone who is authorized to do so does on your behalf requests services;
  • When you or someone else provides information regarding disputes;
  • From Tekagogo’s Third Party Providers who support the Application’s functioning, including by providing GPS services, processing payment, running background checks, or linking to social media services;
  • From our parent, affiliate, or subsidiary companies, business partners, and other third parties, including our marketing partners; and,
  • Through Cookies that we use on our app and website to identify your site usage, browser types, IP addresses, and other data as described in our Cookie Statement

(b) Location Information

Certain functions of the Application require the use of geolocation information and may locate you using one or a combination of GPS, Wi-Fi, cellular triangulation, and Bluetooth iBeacons.  We only use location information if you have provided consent for Tekagogo to do so by enabling Tekagogo’s access to your device’s location services. Disabling your location services will also disable some or all of the Application’s features and may affect your experience.

(c) Payment Information

Tekagogo will not directly collect, process, or store financial or payment card information. Instead, Tekagogo relies on a Third Party Provider—Braintree—to process payment information. Braintree’s Privacy Statement contains more information about how Braintree collects, processes, and uses your information.

(d) Transaction Information

We collect transaction details related to your use of the Application, including the type of service requested and/or performed, date and time the service was performed and/or completed, and other related transaction details.

(e) Communications Data

The Application enables users to communicate with each other and Tekagogo through the Tekagogo app, website, and other services. For example, we enable Teks and Users to call or text each other (without disclosing their telephone numbers to each other). To provide this service, Tekagogo receives some information regarding the calls or texts, including the date and time of the call/text, and the content of the communications. Tekagogo may also use this information for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services and for analytics.

(f) Usage Information

The Application automatically collects some of your usage information when your computer or mobile device connects with our servers.  This includes information about how you use and navigate our app or website. It can include the number and frequency of visitors to each web page and the length of their stays, geographic location, browser type, and IP addresses. We also may determine the applicable technology available to serve you the most appropriate version of a web page, e-mail, promotional announcement or similar service. This information is used to analyze and improve the Application and to provide you with a more personalized and fulfilling experience.

(g) Contacts’ Information

If you permit the Application to access your contacts or address book, we may access and store names and contact information to facilitate social interactions through the Application and for other purposes described herein or at the time of consent or collection.

(h) Device Information

We may collect information about any devices you use to access the Application, including, but not limited to, the manufacturer, model, operating system, software, file names and versions, unique device identifiers, and mobile network information.

(i) IP Addresses

An IP address is a number that is assigned to your computer, mobile device, or network when you are linked to the Internet. When you access the Application, our servers log your IP address. Tekagogo may use IP address information for a number of purposes, such as system administration, to report aggregate information to our business partners, or to audit the use of the Application. Tekagogo may also associate your IP address with the Personal Information you provide.

(j) Ratings and Feedback Lookup

To help create a respectful and safe environment we collect the ratings and feedback that you give. After every trip, Users and Teks are able to rate each other, as well as give feedback on their satisfaction with the Application and their experience. This two-way system holds everyone accountable for their behavior.

(k) Cookies

Like many sites, Tekagogo uses browser Cookies. A cookie is a small amount of data generated by a website that is temporarily saved on your web browser. Its purpose is to remember information about how users interact with web pages or applications, as well as users’ preferences and customization selections. We use cookies to help us optimize you experience when utilizing the Application by analyzing your use of the Application.

Most browsers automatically accept cookies as the default setting. You can modify your browser settings to reject cookies. However, some cookies are necessary for some features of the Application to function and disabling cookies may stop it from working properly.   1. How We Use Your Information

In addition to the uses described above, generally, we use your information to:

  • Register or update your account;
  • Verity your identity;
  • Provide you with the Application;
  • Fulfill your requests;
  • Communicate with you;
  • Enable you to communicate with Teks or Users;
  • Provide customer service;
  • Alert you to product information;
  • Help us improve and customize our service offerings, websites and marketing;
  • Send you information about our products, services and promotions; and
  • Protect the security or integrity of the site and our business.

To accomplish these purposes, we may combine your Personal Information with other data we collect online or offline, including information from third parties.

We also use your data to help maintain safety and security. This includes, for example:

  • Pre-screening Teks and Users prior to enabling their use of the Application, and screening again at subsequent intervals, including through background checks where permitted by law;
  • Cross referencing your profile data, location, device or related information to prevent, detect, and combat fraud or unsafe activity; and
  • Reviewing information from Teks’ devices to identify unsafe or unsatisfactory behavior such as speeding, misuse of the software or substandard work or reviews.
  1. How We Safeguard Your Information

Tekagogo takes reasonable steps to protect information we collect from you to prevent loss, misuse and unauthorized access, disclosure, alteration and destruction. Servers on which information is stored are kept in a controlled environment with limited access. Whenever you give Tekagogo sensitive or confidential information, we will take reasonable steps to protect the information by establishing a secure connection with your web browser. Tekagogo uses an industry-standard security protocol for encrypting sensitive information. However, because even these cutting-edge methods to secure information have been exploited in other companies, we cannot and do not ensure or warrant the security of any information you transmit to Tekagogo and you do so at your own risk.

While we take reasonable efforts to guard Personal Information, no security system is impenetrable. Tekagogo urges you to take steps to keep your information safe by memorizing your password or keeping it in a safe place (separate from your account information), logging out of your account and closing your web browser when not utilizing the Application. Please advise us immediately at support@tekagogo.com if you experience suspicious activity on your account or you believe your account or password has been compromised. Please note that we will never ask you to disclose your password in an unsolicited phone call or email.

  1. Information Sharing

We do not sell or otherwise disclose personal information about you, except as described in this Privacy Statement.

(a) Third Party Providers

Tekagogo may share personal information with “Third Party Providers” that support our business operations. Generally, these Third Party Providers include billing and refund vendors, payment card processors, security firms and companies that help us improve our product and service offerings.

  • Users: When you request assistance with Information Technology or smart devices, our trusted Third Party Provider Pact One will provide you with the solutions you need. Pact One may have access to patient data or Protected Health Information (“PHI”) when doing so. However, Pact One does not share any patient data or PHI with Tekagogo, and Tekagogo does not use, disclose, or otherwise have access to any PHI. Consequently, Tekagogo is not a “Business Associate” as defined under the Health Insurance Portability and Accountability Act of 1966 or related rules and regulations.
  • Teks: We must provide some of your Personal Information to GoodHire to conduct background checks. We also provide your Personal Information to ADP to process payments.

Your information may be stored and processed by our Third Party Providers in the United States or other locations where the Third Party Providers maintain facilities. We require our Third Party Providers to keep your information secure. In addition, our Third Party Providers may not use or disclose personal information for any purpose other than providing the services on our behalf.

(b) Marketing

Teks may collect information about Users’ equipment make, models, types, etc., while responding to Leads. We may provide information to select outside companies when we believe their products or services may be of interest to you. If you opt in to receive communications from a third party, your information will be subject to the third party’s privacy Statement and not this Privacy Statement. Therefore, if you later decide that you do not want that third party to use your information, you will need to contact the third party directly.

(b) Aggregate Information

Tekagogo may disclose non-identifying, aggregated user statistics to third parties for a variety of purposes, including describing the Application to prospective partners. Examples of such non-personal information include the number of users who may have utilized the Application during a specific time period.

(c) Corporate Change

In addition, we reserve the right to disclose, share and/or otherwise transfer your information, including Personal Information, in connection with a corporate merger, acquisition, consolidation, the sale of a portion of our business or the sale of substantially all of Tekagogo assets, or other fundamental corporate change, whatever form it may take. You will be notified via e-mail prior to a change of ownership or control of your personal information, if your Personal Information will be used contrary to this Statement. For clarification and the removal of doubt, Tekagogo specifically reserves the right to transfer or share a copy of personal information collected pursuant to this Privacy Statement from the Application, off-line or otherwise, to the buyer of that portion of its business relating to that information.

(b) Legal Obligations

Tekagogo may release your information, including Personal Information, when legally required to do so, at the request of governmental authorities conducting an investigation, or to verify or enforce compliance with the policies governing the Application and applicable laws. We may also disclose such your information whenever we believe disclosure is necessary to protect the rights, property or safety of Tekagogo, or any of our respective affiliates, business partners, customers or others.

  1. External Links

The Application may utilize links to or advertisements about non-Tekagogo websites or services. Tekagogo does not endorse or sponsor other websites, is not responsible for the privacy practices or the content of non-Tekagogo sites, expressly disclaims any statements or assertions made on such websites, and denies all liability associated with your use of, and the content on, such other websites and advertisements. Please be advised that the practices described in this Privacy Statement do not apply to information gathered through other websites and/or applications. We encourage you to be aware of when you leave this Application and to read the privacy policies of each and every website or service that you visit.

  1. Third Party Advertisements

We may, from time to time, permit various outside ad-serving or other companies to serve advertisements in the Application. In the process of serving advertisements, such companies may use cookies or information about your visits to our website or other sites to provide with advertisements about products and services that may be of interest to you. We may also share information that we collect with our business partners to provide you with promotional or advertising materials.

  1. How You Can Access, Correct, and Update Personal Information

You can access, correct and update certain Personal Information that you have provided to us by emailing us at support@tekagogo.com. Please be aware that we will process your request as quickly as we reasonably can, but it may not be possible to update our systems immediately.

In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.

  1. Sharing Pages with Friends

The Application may offer you the possibility of connecting your accounts from third party social media sites, such as Facebook and Twitter, through an application programming interface (API) or other software.  By allowing the Application to connect with such accounts, you consent to our accessing the information in those accounts, which may include Personal Information. You likewise consent to our publishing of any such information from third-party sites on the Application. Additionally, you understand that by accessing the Application via your social media account, activity you engage in through the Application may be published on the third-party site. It is your choice whether to use any such third-party sites, and you understand that in some instances such third-party sites may request to access and publish information about you or your friends from Tekagogo.

  1. User Submissions

Please review our restrictions on use and guidelines in our [Terms and Conditions].  In addition, please note that this Privacy Statement does not apply to any information you may disclose publicly. You should keep in mind that whenever you publicly disclose information about yourself online, that information could be collected and used by people that you do not know.  Tekagogo assumes no responsibility for any action or policies of any third parties who collect any information users may disclose in request, message, or alert, if any, on the Application.

  1. Children and Minors

We recognize the importance of safeguarding the privacy of children and encourage parents to check and monitor their children’s use of online activities regularly. The Application is compliant with the Children’s Online Privacy Protection Act (“COPPA”) and other applicable laws because is is not aimed at or intended for users under the age of 16. No Personal Information is purposefully or knowingly collected from children under the age of 16 by Tekagogo.  If you are under the age of 16, please do not use Application. If we discover that a person under the age of 16 has provided us with any personal information, we will use commercially reasonable efforts to delete that information from our systems.

  1. Arbitration & Class Action Waiver

WITH LIMITED EXCEPTION, YOU ARE BOUND TO THE ARBITRATION AGREEMENT IN OUR [TERMS AND CONDITIONS], SECTION 2, WHICH IS INCORPORATED HEREIN BY REFERENCE AND WHICH REQUIRES YOU AND TEKAGOGO TO SUBMIT CLAIMS AGAINST EACH OTHER TO BINDING AND FINAL ARBITRATION ON AN INDIVIDUAL BASIS.

  1. Choice of Law

The [Terms and Conditions]and Privacy Statement, and the relationship between you and Tekagogo shall be governed and construed in accordance with the laws of the State of California. In the event a disputes or claims not subject to arbitration, you agree not to commence or prosecute any action in connection therewith other than in the state and federal courts located in San Diego, California, and you consent to personal jurisdiction and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction.

  1. Notice to California Residents and California Do Not Track Disclosures

California residents are entitled once a year to request and obtain certain information regarding our disclosure, if any, of personal information to third parties for their direct marketing purposes during the immediately prior calendar year (e.g. requests made in 2011 will receive information about 2010 sharing activities). As set forth in this Privacy Statement, we comply with this law by offering our visitors the ability to tell us not to share your Personally Information with third parties for their direct marketing purposes.

(a) Opt-Out Procedures

As explained above, we may allow ad exchanges, web analytics vendors, social networking platforms and other third-parties to collect certain data and other non-personally identifiable information when you use the Application. These companies may use non-personally identifiable information (e.g., search and click stream information, browser type, time and date, the identity or type of advertisements clicked or scrolled over) during your visits to this and other web sites to provide advertisements about goods and services likely to be of interest to you. For example, these companies may use a cookie or web beacon to collect this information.

You can choose to opt-out of these marketing services by sending an e-mail to support@tekagogo.com. You must include “Tekagogo” as the subject line, and your full name, e-mail address, and postal address in your message. Opt-out requests will not apply to transactional service messages, such as security alerts and notices about your current account and services.

(b) “Do Not Track” Requests

Some web browsers have the ability to enable users to send “Do Not Track” requests and block your online activity from being tracked across web pages or devices.  However, the Application does not recognize “Do Not Track” browser signals because doing so would interfere with the functionality of the Application.

You may, however, visit the relevant third party’s website directly to manage cookies stored on your machine by them or our Third Party Providers who utilize cookies or beacons to provide you with advertisements.

  1. Your Choices/Unsubscribe

You will have an opportunity to unsubscribe from receiving promotional material from the Application by clicking on an “UNSUBSCRIBE” hyperlink contained in any promotional emails we send you, replying “STOP” or “QUIT” in response to any text messages you receive and by following the instructions in any telephone call you receive.   1. Revisions to Privacy Statement

You acknowledge and agree that Tekagogo may, in its sole discretion, modify, add or remove any portion of the Privacy Statement at any time and in any manner. If a revision is determined to be material by our sole discretion, Tekagogo will notify you of the change. No changes to the Privacy Statement occurring after a dispute between you and Tekagogo arises will apply retroactively. It is your responsibility to check periodically for any changes we make to the Privacy Statement. If you provide information to us or access or use the Application in any way after this Privacy Statement has been changed, you will be deemed to have unconditionally consented and agreed to such changes.
